The Clean Water Act (CWA) has been used effectively to clean up waterways across the country since 1972. Compared to conditions 40 years ago, the current recovering state of many lakes and rivers highlights the CWA's effectiveness. Despite its success, Senator Ben Cardin and three other senators propose to amend the CWA by pushing the Chesapeake Clean Water and Ecosystem Restoration Act of 2009 (or the "Cardin Bill") through the U.S. Senate. This new act purports to address the continuing environmental decline of the Chesapeake Bay watershed by introducing some very fundamental changes to the way the CWA has functioned for almost four decades. In addition, the new act is being touted as a national model for amending the Clean Water Act in years to come. Some of these changes include:
- Requiring states to create NPDES permitting exemptions (which could apply to sources such as developers, wastewater utilities, and agricultural producers that are required to have permits under current law).
- Providing a safe harbor from enforcement for agricultural operations.
- Mandating a pollutant trading scheme allowing polluters able to reduce their nutrient pollution to sell "credits" to other nutrient polluters on the Bay. (There is nothing in the Bill requiring credit generators to monitor their practices and verify that nutrient loads are being reduced.)
Recently, the new Act was passed by voice vote and reported out of the Environment and Public Works Committee. Most likely, the Act will be bundled with other water and land bills, and sent to the entire U.S. Senate for a vote in September or October, 2010.
Please contact your U.S. Senators right now and tell them not to support the Chesapeake Clean Water and Ecosystem Restoration Act of 2009! The Cardin Bill could be bundled with The Great Lakes Ecosystem and Restoration Act of 2010, the Columbia River Restoration Act of 2010, the Puget Sound Recovery Act of 2009, the San Francisco Bay Restoration Act and the Long Island Sound Restoration and Stewardship Act.
