TRANSIT FORUM HUGE SUCCESS!

The June 26 forum Transit: Is Wake County Ready for it? attracted almost 300 attendees, and the enthusiasm in the room was palpable! Transit is an issue clearly gaining public support, and this event hopefully ignited the spark needed to bring a bold transit plan to our county and region.

Keynote speaker Carol Coletta CEOs for Cities, commented that
our region has many assets that make a great city, minus one important component - transit. We risk losing what is great about our home if we fail to plan for future growth. Transit and coordinated land use planning must be a priority for our community.

Other speakers talked about Charlotte's success story, and the new proposal for regional transit recommended by the Special Transit Advisory Commission. Elected officials from across Wake County attended the event, as did representatives of community organizations, business leaders and local government staff. Forum panelists were engaging and explained what opportunities transit can provide for economic development and a better quality of life.

ITEM 1. DROUGHT CONCERNS

On Thursday, Gov. Mike Easley said the drought in North Carolina could be worse this year than the conditions that plagued the state last year.

The federal drought map released Thursday shows 14 western counties in exceptional drought, twice the number from last week. Ninety-seven of the state's 100 counties are in some level of drought. Most of Wake County remains in the “Moderate Drought” category; however, parts of western Wake are back into the “Severe Drought” category. Click here to view the drought map.

ITEM 2. POTENTIAL GRANT APPLICATION / FINANCING SOURCE FOR SIDEWALK PROJECT

If you recall from previous Friday Memos, staff met with USDA Rural Development staff back in March to discuss funding / financing options for the town’s future capital needs. Staff met with these same folks this week to discuss specific alternatives for funding and financing for a downtown sidewalk project. The meeting was encouraging. Staff discussed the possibility of the town pursuing a Rural Business Enterprise Grant (RBEG) of $75,000 for some initial funding and the potential of financing the remainder of the project through a federal loan, which could be paid back over a number of years. (Town Manager David Bone was successful in securing a RBEG grant for sidewalks in Elizabethtown.) Commissioners will be asked to give feedback about this potential funding source and strategy at the July 14th Board of Commissioners meeting.

ITEM 3. ANNEXATION MORATORIUM BILL UPDATE

The House Judiciary II Committee adopted a revised version of HB 2367 – Involuntary Annexation Moratorium on Tuesday. The revised bill prohibits city-initiated annexation ordinances from becoming effective between July 31, 2008 and April 30, 2009. HB 2367 is now on the calendar for a vote by the full House, and the vote is expected early next week. If it passes the House, it will then go to the Senate for consideration.

ITEM 4. DOWNTOWN HISTORIC DISTRICT MARKER DEDICATION / JULY 4TH PARADE

The Wendell Historical Society has festivities planned for July 4th. An unveiling ceremony for the downtown historic district marker is planned for 4:00 p.m. at the corner of Depot St. and Main St., and then there will be a “bicycle and stroller parade” to J. Ashley Wall Park, where lemonade and cookies will be served. The society hopes that this will be the beginning of an annual 4th of July celebration for Wendell.

ITEM 5. TRIANGLE BUSINESS JOURNAL TO HOST MEETING ABOUT “THE STATE OF EASTERN WAKE” – FRIDAY, JULY 18TH

The Triangle Business Journal will host a continental breakfast / symposium about “The State of Eastern Wake” on Friday, July 18th from 7:15 a.m. until 9:30 p.m. at Faith Baptist Church in Knightdale. The cost is $15. RSVP here or call Becky at 327-1004.

The Triangle Business Journal is also working on a series of articles about eastern Wake County, which will be in an upcoming edition of the newspaper.

ITEM 6. OTHER:

A. Next week is “New Year’s” for the Finance Department. The fiscal year ends on Monday, June 30th, and the 2008-09 year begins on Tuesday. There are additional task that must be completed by the Finance staff during this time to close-out the year and to start afresh with the new fiscal year.

B. Town offices will be closed next Friday for the July 4th holiday.

C. The Board of Commissioners has been invited to the Greater Raleigh Chamber of Commerce annual Partners Dinner. The dinner will take place at 6:00 p.m. on Thursday, July 24th. D. The portion of Martin Pond Road that closed on April 14th for the Wendell Falls construction is scheduled to re-open around the middle of August.

The N.C. SENATE PASSED REPEAL OF TRANSFER TAX (this is another victory of the real estate lobby!!) -- PLEASE URGE N.C. HOUSE OF REPRESENTATIVES TO OPPOSE SB 1951, WHICH WOULD REPEAL THE TRANSFER TAX OPTION FOR ALL COUNTIES.

After SB 1951-REPEAL TRANSFER TAX passed 2nd reading on the Senate Floor last week, an amendment of was approved Sen. Doug Berger (D-Franklin) objected to 3rd reading so that he could offer an amendment the next day to earmark the proceeds of a sales tax for school construction. On Thursday, Sen. Berger put forth his amendment that would restrict the use of any local sales and use taxes for school capital outlay purposes. Please note that the bill would still repeal the land transfer tax. That part of the bill was not involved in the amendment. While debating the amendment, Sen. Dan Clodfelter (D-Mecklenburg) said that he thought earmarking the funds only for school construction was too restrictive. They displaced the amendment while Sens. Berger and Clodfelter worked on a perfecting amendment. The amendment that was adopted allows counties to "restrict use of the additional one-quarter cent sales tax to an enumerated purpose or purposes." The amendment was adopted by a vote of 35/9, with 6 Senators not voting. The amended bill passed 3rd reading by a vote of 38/6, with the same 6 Senators not voting. The bill was engrossed (meaning the amendment is now part of the bill) and sent to the House. Because of the amendment, the title changed to:

AN ACT to repeal the authorization for all counties to levy a four-tenths percent local land transfer tax, and to allow counties to restrict use of the additional one-quarter cent sales tax to an enumerated purpose or purposes.

PLEASE URGE THE HOUSE TO VOTE NO ON SB 1951 --
If the House votes to repeal the transfer tax option, then Wake County would be unable to use a transfer tax to pay for schools, or other growth-related infrastructure.

  • The Realtors lobby spent millions of dollars to defeat what they called "the home tax." Why not call it "the shopping center tax" - it applies to all property sold.
  • County governments cannot advocate for a position and they certainly cannot compete with the misleading and well-financed media campaign of a statewide political action committee.
  • The six (6) counties that already have the ability to raise a local option real estate transfer tax have seen their property taxes go down (not up) and have seen their schools improve.
  • Counties put the transfer tax on the ballot prematurely - without the proper voter education.

The Wendell Board of Commissioners will have their regularly scheduled monthly work session meeting on Monday, June 23
at Town Hall at 7pm. The agenda is posted on the town web site.

The main item of interest on the agenda is a rescheduled public hearing
(rescheduled because the town failed to advertise the public hearing as required by law) on the proposed FY 2008-2009 budget which includes a sizeable property tax increase and several controversial items. As most of you know, Wake County and the Fire District are also planning property tax increases. A draft copy of the budget can be viewed on the town web site.

This afternoon, Sen. David Hoyle (D-Gaston) ran his bill, SB 1951-REPEAL TRANSFER TAX on the Senate Floor. It passed 2nd reading by an overwhelming 38/9. The bill is on the Senate calendar for 3rd reading tomorrow, Thursday, June 19th. The Senate convenes at 10 a.m. so we don't have much time to call and email to oppose this bill.

We are grateful to the 9 Senators who voted NO: Sens. Albertson, Atwater, Basnight, Dannelly, Dorsett, Graham, Jones, Kinnaird and McKissick.

Neuse River Foundation Update

Neuse River Foundation has requested a public hearing to address six
failing sewage and industrial treatment plants in the Neuse River
Basin. Upper Neuse Riverkeeper Dean Naujoks will be challenging the
renewal of several National Pollution Discharge Elimination Systems
(NPDES) permits for dischargers who have consistently failed to meet
permit requirements and water quality standards at a Public Hearing
scheduled for June 19 at 7 P.M.

Since 2000, NRF has challenged 25 NPDES permits involving the most
chronic violators in the Neuse River Basin. We have been successful
making improvements or adding additional provisions in 22 out of 25
discharge permits we have challenged.

Citizen input is an important part of the NPDES permit review process
as permits are often renewed over and over again, with no regard to
the histories of violations, unless citizens object.

For example, Southern Granville County Water and Sewer Authority’s
sewage treatment plant, formerly Butner, has had a long history of
compliance problems that have contributed directly to declining water
quality in Falls Lake— a drinking water supply for 400,000 Wake County
Citizens. Since 2003, this plant has received 86 Notice of Violations
or enforcement actions by the state, totaling more than $61,000 in
fines and penalties. Falls Lake was listed as impaired from pollution
on the states 303d “Impaired Waters” list.

It is time for these facilities to comply with the Clean Water Act and
protect our water resources. A strong public turn out sends an
important message to the NC Division of Water Quality that status quo
permit renewal is not acceptable.

ITEM 1. ANNEXATION MORATORIUM DISCUSSED IN FINANCE COMMITTEE ON THURSDAY

By a vote of 25 to 4, the House Finance Committee on Thursday gave a favorable report to HB 2367- Involuntary Annexation Moratorium. This bill will place a moratorium on all city-initiated annexations, including pending annexations, until June 30, 2009. An amendment to shorten the period of the moratorium failed. The bill now moves to the House Judiciary II Committee. Members of the House Judiciary II Committee include Rep. Dan Blue (Chair) and Rep. Jennifer Weiss (Vice-Chair), both of Wake County.

ITEM 2. DOWNTOWN HISTORIC DISTRICT MARKER DEDICATION / JULY 4TH PARADE

The manager and police chief met with Nora Cambier, President of the Wendell Historical Society, on Tuesday concerning a desire for an unveiling ceremony for the downtown historic district marker. The town Public Works Department staff will install the sign.

Mrs. Cambier filled-out a parade permit for the festivities. An unveiling ceremony is planned for 4:00 p.m. at the corner of Depot St. and Main St., and then there will be a “bicycle and stroller parade” to J. Ashley Wall Park, where lemonade and cookies will be served. The society hopes that this will be the beginning of an annual 4th of July celebration for Wendell.

ITEM 3. CONCERN ABOUT WATER SUPPLY / DROUGHT STATUS UPDATE

So far, Falls Lake is still full (251.34 feet MSL as of 1:00 p.m. today – 251.50 feet MSL is considered full). To check on the level of Falls Lake, click here.

Wake County has been upgraded from “Abnormally Dry” to “Moderate Drought” on the NC Drought Advisory Council web site. To view the map, click here.

ITEM 4. UPDATE ON FIRE DISTRICT TAX

Wake County Commissioners appeared ready Monday to approve an increase in the fire tax paid in the 19 rural fire districts the levy goes to support. County Manager David Cooke has proposed a fire tax for next year of 8 cents per $100 of assessed property value, a nearly 8 percent increase over the current tax (but a decrease from the current rate of 10 cents). The money would pay for more full-time firefighters at fire stations historically staffed by volunteers. Last month the Wake County Fire Commission voted unanimously to ask the commissioners to raise the fire tax 31 percent next year and 73 percent by 2015 to add more professional firefighters.

The county may adopt this rate at its June 16th meeting.

ITEM 5. RALEIGH WATER FEES

The City of Raleigh is considering alternatives to raising water use fees in the 2008-09 budget. Adopting such a water/sewer impact fee was discussed last week during the Raleigh council's budget deliberations. Several council members argued that the revenues generated by the fee would help shield Raleigh's water customers from future rate increases.

City Manager Russell Allen's proposed budget does not include capacity fees for water and sewer. It does, however, include a 15 percent increase in the water and sewer rate, which would amount to a $4.86 monthly increase for an average Raleigh household that uses 6,000 gallons a month.

The Raleigh City Council currently has budget meetings scheduled for June 16th and 23rd. The water/sewer impact fee option is expected to be discussed during these meetings.

ITEM 6. TIME-WARNER CABLE SPIN-OFF FROM THE TIME WARNER PARENT COMPANY

The board will be asked to in the near future to approve a transfer of the local Time Warner franchise as part of the spin-off of Time Warner Cable (TWC) from the Time Warner parent company. Quite simply, TWC will ask the board to put forth a resolution approving the transfer of the franchise. Nothing about our local services or operations is supposed to change.

ITEM 7. LAKE MYRA PARK UPDATE

The second community forum about the plans for Lake Myra Park (concerning programming and visioning) was held on Thursday, June 12th. The town was well represented. The presentation from this forum is available online here. Design alternatives will be discussed at the next forum, which will be held on Thursday, July 31st at 7:00 p.m. at the Wendell Community Center.


ITEM 8. OTHER:

A. Verizon Wireless has spoken to town staff about the possible co-location of a wireless antenna at the water tower on 315 Poplar Street. If this comes to fruition, it would help improve cell service in the area.

C. El Cerro Grande continues to move forward with its permits and renovations of The Meeting Place.

D. El Fagon is back on the table. A sign was installed this week. There may be two Mexican restaurants in Wendell’s not-so-distant future.

E. Town Manager David Bone will be on vacation June 16 – 18. He will be at the NC City / County Managers Conference June 19 -21.

F. A copy of the June 16th Planning Board Meeting agenda is at the end of this memo.
